1.0 Introduction
The IGAD Climate Prediction and Applications Centre (ICPAC) is a specialized Institution of the Inter-Governmental Authority on Development (IGAD). The mission of ICPAC is to provide climate information, prediction and timely early warning for applications in support of environmental management, disaster risk reduction and sustainable development in the Horn of Africa. ICPAC plays a central role in addressing the objectives and goals of IGAD Drought Disaster Resilience and Sustainability Initiative (IDDRSI) mainly in respect to Multi-hazard early warning (MH-EW) and Disaster risk Management (DRM). ICPAC extend its services to 4 main sectors and fulfil the recommendations of the World Meteorological Organization’s Global Framework for Climate Services (GFCS): Water, Agriculture, Health and DRM.
ICPAC is implementing with the support of UNDP the project “Strengthening the Capacity of IGAD in Building resilience in the Horn of Africa”. The project is focused on the achievement of four key outputs: Strengthened capacity of IGAD to plan, implement and coordinate the drought Emergency activities; Make Available Drought Resilience and Disaster Risk Management related knowledge products, policies and systems; Development and Implementation of IGAD’s Resource mobilization and Partnership strategy to strengthen the Drought Resilience in the Region; Strengthened National Coordination Mechanisms of Member states for Drought Resilience.
In its effort to improve IGAD and National/Member States’ Human Resource Capacity for Building Drought Resilience, Conflict Prevention, and DRM, especially in enhancing Policy and Regulations to address challenges associated with climate risks, ICPAC wishes to engage a Legal Advisor within the framework of this project.
2.0 Overall Purpose
To Provide reliable, accurate, timely and well-informed advice to the ICPAC Director on legal issues and the potential legal implications of various corporate strategies, initiatives and projects as well as supporting related needs of IGAD, UNDP project, and other specialized institutions/programmes in support of Building Disaster Resilience capacity in the Horn of Africa.
3.0 Core Duties and Responsibilities
• Contributes to formulate and develop legal strategy, plans and budget to ensure the legal policy guidelines implementation and adherence.
• Works on legal matters such as new agreements, reviewing existing agreements, establishing new partnerships, issue necessary documents to meet the requirements of multinational laws & maintain the correct legal position of ICPAC.
• Maintains custody of records by ensuring that the records of the organization are maintained as required by law and made available when required by authorized persons. These records may include founding documents, lists of members, committee meeting minutes, and other official records.
• Provides a legal advice on the potential liability, in order to take necessary steps to control the institution exposure.
• Assists HR on revising employment contracts to facilitate the recruitment or dismissed of employees and to insure its conformity to Labor Laws and IGAD regulation.
• Contribution on establishment of legal guidelines for tenders and review all commercial contracts that ICPAC enters to ensure its interest are safe guarded.
• Formulate, provide, advise and / or review all contracts agreements between the company, third parties and new partnership to ensure that the Institution’s interests are fully protected and redress of grievance obtained.
• Monitor the implementation of the legal clauses of all contracts.
• Direct control, prepare, responds and lead the legal action and legal proceedings to help and improve the collection of the receivables and defend the Institution’s interests.
• Provide professional, written and oral, legal advice to the Director and offices regarding the legal procedures and practices.
• Provide training on legal issues to the Officers to make sure that they are fully qualified to represent the Institution and to act accordingly.
• And any other related duties as may be assigned by the Director of ICPAC.
4.0 Minimum Qualifications and Experience
• Juris Doctor (JD) or Bachelors of Laws (LLB)
• Three (3) years of working experience.
• Proven track record of drafting, reviewing and editing agreements and contracts.
• Familiar with local and international laws and regulations (esp. Environment laws)
• Advanced PC skills and sound knowledge of the MS Office package: MS Word,Excel, Outlook, Power Point;
• Experience of working in East African context.
